GENERAL SALES TERMS
1. DEFINITION AND SCOPE OF THE CONTRACT
This contract is a distance contract under the Italian legislation (D.Lgs. n.185/1999). object of the contract are movables and it is drawn up between the company Andrum S.n.c. with headquarter in the city of Andria (Italy), via Spartaco 50, VAT Code 04110280726, and you (the customer). The contract for the purchase of products is completed directly through the acceptance by Andrum SNC of an acquisition proposal issued by the Customer by telephone, electronically or via the Internet, following the invitation to offer content in our website, and based on the procedure explained in chapter 2. These conditions of sale, and in particular the information referred to in Article. 3 and 4 of D. Lgs. N.185/1999, as provided by Andrum SNC, reported by telephone to the Customer and / or contained in the website, will remain effective until they are changed by Andrum SNC. Any changes to the conditions of sale will be effective from the date they will be made public and will apply to sales made after that date. The latest updated version of the general conditions of sale of Andrum SNC is available on its website.
2. PRICES - PURCHASING TERMS - PAYMENT
The sales prices of products shown on the Site and / or through any other means of distance selling of Andrum SNC are believed to be VAT and all other taxes excluded. Delivery costs are indicated on the Site and / or through any other means of distance selling of Andrum SNC and in the case of orders by telephone, repeated by the operator of the Customer Andrum SNC. The costs of delivery for orders of products placed on the site are calculated from time to time based on the products ordered and are shown in the purchase order.
2.1 The purchase contract by telephone is finalized by Andrum SNC through the communication to a client that the proposal has been accepted. On this occasion, the customer has made a purchase proposal providing also the operator with information necessary for the procedure of registration of its name, purchase order and payment method, chosen among those in Section 2.3.
2.2 In the event of purchasing proposals submitted through our websites, the customer will receive an e-mail summary from Andrum SNC informing him that his proposed purchase is being drawn up and will be deemed to be accepted. If the purchasing proposal will be subject of a reject, the customer will receive an e-mail or telephone communication from Andrum SNC within 3 days of receipt of the e-mail summary.
2.3 The customer will be allowed to choose one of the following payment methods: (a) cash on delivery, to be made to the courier who delivers the product or (b) by credit card, or (c) any other means of payment listed as valid by Andrum SNC on its website.
3. CONTRACT EXECUTION - DELIVERY OF PRODUCTS - COMPLAINTS
Andrum S.N.C. deliver the goods by trusted courier and / or vectors within 30 days after the conclusion of the contract. Any complaint will be forwarded to: Andrum SNC Via Spartaco, 50 Andria (BA) - ITALY.
4. PRODUCT AVAILABILITY
Andrum S.N.C. accepts orders for products within the limits of the quantities stocked. Therefore the acceptance of the Offer is subject to the availability of stock of such products. Andrum S.N.C. undertakes to promptly inform the customer of possible unforeseen depletion of stocks due to excess demand or other causes.
5. GUARANTEE
On The goods purchased by the customer is applied the guarantee and assistance of the manufacturer or importer, as required by current legislation.
6. CUSTOMER OBLIGATIONS
The customer claims to be a consumer according to D. Lgs. N.185/1999 and be of age, and also that the data supplied by him are correct and true.
7. RIGHT OF WITHDRAWAL
The customer has the right to terminate the contract without penalty and without specifying the reason within 30 days of receipt of goods. The withdrawal must be manifested in that period by calling the telephone number: +39 0883 558018. Customer must ship the products within 30 days of receipt. Further instructions for the exercise of termination are contained in previous articles. Customer may not cancel within the period provided for exercising the right of cancellation in case of purchase of tailored, personalized, perishable or alterations to their nature as envisaged by Legislative Decree no. N.185/1999. The costs of returning products are borne by the customer. Andrum S.N.C. will return within 30 days from the date of shipment of goods by the Customer (i) the overall price paid by Customer in the event of returning the product to complete all parts of capabilities and tangible and intangible or (ii) the portion of the price equivalent to the actual product returned by customers who have consumed the product in an appreciable and / or which significantly diminish the value.
8. GRANT, TREATMENT AND CONFIDENTIALITY OF PERSONAL INFORMATION
The customer's personal data are collected with the consent of the customer to record the client and carry out the procedures for implementation of the Agreement, and for the necessary notifications. These data, for which confidentiality is assured by proper safety measures according to law, shall be electronically processed in compliance with applicable laws and may be disclosed to persons (including carriers, shippers and banks) delegated to carry out activities necessary for the execution of the contract and only for that purpose or, only upon request, to the courts or other authorities authorized by law to take such data. Owner and responsible for the collection and processing of personal data is Andrum SNC, Via Spartaco, 50 Andria (BA) - ITALY. The customer benefits of the rights under Art. 7 del D. Lgs. 196/2003, and in particular may ask confirmation of the existence of his personal information at Andrum SNC; may know their origin, logic and purpose of their treatment and can obtain the update, correction and integration; ask its cancellation, transformation into anonymous form or block in the event of unlawful processing, for legitimate reasons, may object to their treatment. Andrum S.N.C. will retain in its records the documentation provided by the client who has express his consent to the processing of data by Andrum SNC for sending advertising material and / or business information and to carry out market research and direct sales business.
9. JURISDICTION
Any dispute regarding the application, execution, interpretation and breach of contract of sale is subject to Italian jurisdiction and will be the responsibility of the Forum of Trani, even if the customer is domiciled abroad.
